Legal Considerations for South El Monte Bus Accidents

Far too many people are killed or seriously injured in bus collisions each year. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury. About 50 passengers (including the driver) are killed, on average, in a given year.” There are a number of factors that can make buses particularly dangerous.

  • Buses have large blind spots that can obscure the presence of smaller vehicles.
  • Buses weigh substantially more than passenger vehicles.
  • Buses have a wide turning radius and are more likely to be involved in side-impact collisions.

Buses are considered common carriers, and their drivers are held to a high standard in terms of safety. They must operate their vehicle at a safe speed at all times. According to California Vehicle Code 22350, no person shall operate a motor vehicle on a roadway at a speed greater than what would be safe given the prevailing conditions of the roadway. If a driver fails to slow down to avoid a collision, this could form the basis of a negligence claim. It is important that certain steps are taken after any bus accident.

  • Medical records should be collected.
  • The police report should be reviewed.
  • Surveillance footage should be sought.
  • An experienced bus accident attorney should be contacted.

There is simply no excuse for a bus to collide with a parked vehicle. These types of collisions nearly always involve some type of traffic infraction. This may include instances where bus drivers were fatigued, distracted, or speeding. Any person injured in a bus crash may have legal recourse through a civil claim. A bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
