Liability For Los Angeles County Inmate Deaths
Heart illnesses remain one of the leading causes of inmate death in the United States. According to the Journal of American Cardiology, “Cardiovascular disease is a leading cause of death among individuals incarcerated, and those recently released have a higher risk of being hospitalized and dying of cardiovascular disease compared with the general population, even after accounting for differences in racial identity and socioeconomic status.” There are many steps that jails should take in order to protect inmates at risk from heart disease.
- All inmates should get a thorough health screening.
- All inmates should be given the opportunity to exercise.
- All inmates should have regular health checkups.
- All inmates should receive the medications that they need.
All inmates have a legal right to receive reasonably adequate healthcare for their medical conditions. This starts when an inmate is first admitted. Inmates should be screened for health issues. Any inmate at risk from cardiovascular disease should receive a number of medical treatments including possibly medication. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. There are many ways that a jail may have contributed to an inmate death.
- A jail may have failed to give an inmate their medication.
- A jail may have failed to get an inmate to the hospital promptly.
- A jail may have been put an inmate in a prone position which restricted their breathing.
A large portion of jail deaths are totally preventable. They are often due to medical neglect. Medical neglect could come in many different forms and involve private healthcare companies. It is common for jails to outsource their healthcare needs to private companies. The family of any person that died in jail may have legal recourse through a constitutional claim.
