Legal Considerations For Alameda County Inmate Deaths
Far too many people die in custody every year in the United States. Many of those dying were homeless and struggling with mental health issues. According to Axios, “In California, the death rate was 40.2 for every 10,000 inmates in 2020 — up 27% from 2019, according to the Marshall Project’s analysis of a study published in Science Advances.” There are a number of factors within a jail that could contribute to any inmate death.
- Deaths are more likely to occur when jails are understaffed.
- Deaths are more likely if inmates are not medically cleared.
- Deaths are more likely to occur if illicit drugs are allowed to enter inside.
When the state assumes control of a person’s autonomy through incarceration, certain constitutional standards will apply. Among other things, inmates have a constitutional right to receive reasonably adequate care for all of their medical conditions. If a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. It is crucial that certain steps are taken after any inmate death.
- Surveillance footage should be sought.
- Medical records should be collected.
- An independent investigation should be conducted.
Inmate deaths are often complex. They may be caused by neglect or a lack of resources within any jail system. It is important that victims of jail neglect and their families understand that they do have rights. In particular, the family of any inmate that died in custody may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
