Liability For Oxnard Police Shootings

Far too many people are killed or seriously injured during police encounters every year. According to Johns Hopkins, “A new study from researchers at the Johns Hopkins Center for Gun Violence Solutions and Vanderbilt University found that an average of 1,769 people were injured annually in police shootings from 2015 to 2020, 55 percent of them or 979 people, fatally.” Police departments should take a number of measures in order to prevent police shootings.

  • Police departments should ensure that all of their officers are trained in de-escalation techniques.
  • Police departments should equip their officers with less-lethal options, such as tasers.
  • Police departments should ensure their officers are trained to follow protocols for dealing with mentally ill suspects.

A police department could be liable for the excessive force of one of their officers. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. Every person in California has a right to live free from the excessive force of the police that is exercised under the color of law. Several steps should be taken in order to determine whether or not any instance of force was excessive.

  • The actions of police officers leading up to a shooting should be understood.
  • Body camera footage from all officers involved should be captured.
  • Eyewitnesses should be interviewed.
  • An experienced civil rights attorney should be contacted.

A large portion of police shootings are preventable. They tend to involve officers who are either unable or willing to de-escalate encounters. In many situations, police officers may make things worse by yelling at suspects and failing to wait for backup. The family of any person who died in a police shooting may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
