Liability For Downey Police Shootings

California has one of the highest instances of police shootings in the United States. According to the Public Policy Institute of California, “About 195 people die each year from interactions with California law enforcement. Gunshots are by far the most common cause of death: nearly 250 people are shot by police each year.”  Many of these fatal shootings involve suspects who are mentally ill. Police officers should take a number of measures in order to avoid harming mentally ill suspects.

  • Police officers should be trained to de-escalate encounters.
  • Police officers should be trained to understand when a suspect may be in the midst of a mental health crisis.
  • Police officers should follow a use-of-force continuum.

Police officers have a great deal of leeway in terms of how they perform their job duties. But at no point are officers allowed to use excessive force. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. If officers fail to follow a safety rule promulgated by their employer, this could serve as evidence of negligence. It is important that evidence is properly preserved after any police shooting.

  • The actions of police officers should be understood.
  • Body camera footage from all officers involved should be sought.
  • Medical records related to the incident should be preserved.

Police shootings are often highly preventable. They tend to involve officers who are either unwilling or unable to properly de-escalate encounters. Sadly, police departments will often do everything in their power to deny responsibility if their officers are involved in fatal police shootings. This is why it is so important to seek legal guidance as early as possible. A civil rights attorney can investigate a police shooting at no charge and determine if officers violated the law.
