Legal Considerations for California Police Shootings

Thousands of people are seriously injured or killed during police encounters every year in the United States. According to the Public Policy Institute of California, “About 195 people die each year from interactions with California law enforcement. Gunshots are by far the most common cause of death: nearly 250 people are shot by police each year.” There are a number of steps that police officers should take in order to reduce the likelihood that a fatal shooting takes place.

  • Police officers should have access to less-lethal options like tasers.
  • Police officers should be trained to de-escalate encounters.
  • Police officers should wait for backup in high-risk situations.

The ability to use lethal force is one of the most consequential powers that police officers hold. It must be used with the utmost discretion in order to preserve life. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. Every person in California has the right to live free from the threat of excessive force exercised under the color of law. It is important that certain steps are taken after any fatal police shooting.

  • The circumstances leading up to the shooting should be understood.
  • Eyewitnesses should be interviewed.
  • Body camera footage from all officers involved should be recovered.
  • The potential history of misconduct involving all of the officers should be reviewed.

Police departments will virtually never accept responsibility when their officers kill a suspect. They may claim that their actions were necessary, but this is not always the case. In many instances, police shootings are the result of officers who are unwilling or unable to de-escalate encounters. It is important for victims of excessive force, and their families, to understand that they do have rights. They may be able to seek some measure of accountability through a civil claim.
