Legal Considerations for Los Angeles County Inmate Deaths

Los Angeles County has one of the highest instances of inmate death in all of California. The Los Angeles County Sheriff’s Department, has reported 29 deaths so far in 2024. Many of these deaths involve people who were never even convicted of the crimes for which they were being held. There are a number of steps that jails should take in order to prevent inmate death.

  • All inmates should get a thorough health screening when they are first admitted.
  • Jails should be stocked with Narcan, which can be used to reverse the effects of an overdose.
  • Inmates should get periodic wellness checks in order to assure that they are alright.

Jails have a legal obligation to tend to the medical needs of the inmates that they hold. Inmates are not able to seek care for themselves the way that a free person would be able to. If a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. There are a number of ways that jails may have failed to properly give inmates care.

  • Ajail may have failed to take an inmate to the hospital in a timely manner.
  • A jail may have failed to address the mental health needs of an inmate.
  • A jail may have not given an inmate the medication that they needed.

It can be hard to know where to begin after any in-custody death. To make matters worse, jails are virtually never transparent about how any inmate death takes place. They will often claim that some death was due to natural causes. But a large number of supposedly natural deaths involve inmates who were not given proper medical treatment. The family of any inmate who died in custody may have legal recourse through a civil claim.
