Liability For Milipitas Inmate Deaths

Thousands of inmates die in custody each year in the US. According to the Bureau of Justice Statistics, “In both 2018 and 2019, more than 90% of prisoner deaths occurred in state prison facilities. Deaths from all causes decreased in state prisons from 2018 to 2019, with the exception of deaths due to drug or alcohol intoxication and homicides.” Jails should take a number of measures in order to prevent inmate deaths.

  • All inmates should get a thorough health screening.
  • Jails should understand the signs an inmate is in medical distress.
  • Jails should prevent fentanyl and other illicit drugs from entering.

Inmates are not able to seek care for themselves as a free person would. Jails must therefore provide inmates with care for all of their medical conditions. Depending on the facts of any case, a jail or private healthcare provider could be liable if an inmate in their care dies. There are many different ways that a jail may have failed to properly care for an inmate.

  • A jail may fail to get an inmate to the hospital in a timely manner.
  • A jail may not have given an inmate the medication that they need.
  • A jail may have failed to help an inmate going through an overdose.

A large number of inmate deaths are preventable. They tend to involve jails with systemic problems. This could include overcrowding. Sadly, though, jails will often do everything in their power to deny responsibility if any inmate in their care dies. It is important that inmates and their families understand that they do have rights. The family of any inmate who died in custody may be able to seek some measure of justice through a civil claim.
