Legal Considerations For Santa Barbara County Inmate Deaths
Thousands of inmates die every year while in custody. According to Health Affairs, “On average, about 1.40 deaths occurred annually per 1,000 incarcerated people. About 0.62 deaths per 1,000 incarcerated people were illness-related deaths, 0.53 were suicides, and 0.15 were acute drug- or alcohol-related deaths. Accidents or homicides were less common (0.03 deaths each).” Jails should take a number of measures in order to prevent inmate deaths.
- All inmates should be medically cleared before they are admitted.
- Jails should be stocked with Narcan in order to prevent overdoses.
- All jails should have adequate correctional officers and medical staff to support the inmate population.
Jails have a legal obligation to provide inmates with reasonably adequate medical care for all of their health conditions. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. For example, an inmate may have needed medication to prevent seizures but may have been denied this medication. A number of inmates with epilepsy have been injured or killed after falls due to a lack of medication. It is important that certain steps are taken after any in-custody death.
- Medical records related to the incident should be preserved.
- An independent autopsy may need to be performed.
- Jail records related to the incident should be reviewed.
Many inmate deaths are completely preventable. They tend to be the result of systemic failures within any jail system. For example, a jail may not have enough medical officials to adequately tend to the needs of inmates. It is important that inmates and their families are aware of their rights. The family of any inmate that died in custody may be able to seek some measure of justice through a civil claim.
