THOUSAND OAKS, CALIFORNIA (December 19, 2024) – A Thousand Oaks nursing home resident has tragically died, and his roommate has been arrested as a suspect.

Los Angeles County officials are saying that the incident began around 4:40 a.m. on Friday. Deputies were called to the Silverado facility on Warwick Avenue.

A resident reportedly became agitated and broke a window. Deputies located a 58-year-old resident and detained him.

Nursing home staff checked on his roommate and noticed that he had severe injuries, which may have been from an assault. The Ventura County Medical Examiner’s office will conduct an autopsy.

A full investigation into the incident remains ongoing at this time.

Legal Considerations for Ventura County Nursing Home Deaths

Violence in nursing homes is unfortunately all too common. According to the World Health Organization, “Abuse of older people is an important public health problem. A 2017 review of 52 studies in 28 countries from diverse regions estimated that over the past year 1 in 6 people (15.7%) aged 60 years and older were subjected to some form of abuse.” Abuse can come at the hands of staff or other residents. Nursing homes should take a number of measures in order to protect residents from violence and abuse.

  • Nursing homes should implement comprehensive background checks for all workers and volunteers.
  • Nursing home staff should be trained to recognize signs of physical and emotional abuse.
  • Nursing homes should assess incoming residents with respect to behavioral and mental health concerns.
  • Nursing homes should be adequately staffed at all times.

Nursing homes have a legal obligation to protect residents from reasonably foreseeable sources of harm. This includes protection from the criminal acts of staff and other residents. If a nursing home has actual or constructive notice that a resident is in danger, they must act. When a nursing home fails to take reasonable steps to protect residents, this could form the basis of a negligence claim. There are a number of ways that a nursing home may be liable for a resident being attacked by another resident.

  • A nursing home may have failed to supervise residents prior to an attack.
  • A nursing home may have failed to follow up on reports of a resident’s aggressive actions.
  • Nursing home staff may have failed to mitigate and de-escalate conflicts between residents.
  • A nursing home may have failed to separate or relocate residents.

The vast majority of abuse and attacks that take place in a nursing home setting are preventable. They tend to involve instances where nursing homes are understaffed or otherwise failing to follow safety procedures. Sadly, though, nursing homes will often do everything in their power to deny responsibility if one of their residents is attacked. It is important that nursing home residents and their families understand that they do have rights. The family of any person who is killed in a nursing home may be able to seek some measure of accountability through a civil claim.
