CALAVERAS COUNTY, CALIFORNIA (November 16, 2024) – A 43-year-old inmate identified as Benjamin Nava has died in custody at the Calaveras County Jail.

Calaveras County officials are saying that the incident took place on November 10. Correctional officers found Benjamin Nava unresponsive in the housing unit, possibly due to a medical event.

Paramedics were called to the scene in order to help the inmate. But efforts to revive him were not successful.

Benjamin Nava was later pronounced dead at the jail. A full investigation into the incident remains ongoing at this time.

Legal Considerations For Calaveras County Inmate Deaths

Jails can seriously exasperate people’s underlying health conditions. It is therefore not surprising that many inmates die in custody. Deaths are more likely at jails with higher turnover rates. According to the National Institutes of Health, “We found that jails with higher turnover rates were likely to have higher overall mortality than jails with lower turnover. Deaths due to suicide, drugs and alcohol, and homicide showed a significant association with high turnover. The average length of a jail stay in 2019 was twenty-six days.” Jails should take a number of measures in order to prevent inmate deaths.

  • Jails should ensure that all inmates have a thorough health screening.
  • Jails should be stocked with Narcan to prevent overdoses.
  • Jails should be adequately staffed with well-trained medical personnel.

Jails have a legal obligation to provide inmates with adequate medical care at all points during their stay. This is important for inmates at risk from overdose or withdrawal. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. A jail could have failed to properly care for an inmate in many ways.

  • Jailofficials may have failed to perform periodic wellness checks.
  • Jail officials may have failed to give the inmate medication that they needed.
  • Jail officials may have failed to identify signs an inmate was in medical distress.

A large number of inmate deaths are preventable. By the time any inmate is found unresponsive in their jail cell, there are often numerous red flags that were missed. Sadly, though, these red flags may be overlooked when jails do not have enough correctional officers. The family of any inmate who died in custody may be able to seek some measure of accountability through a civil claim.
