Liability For Los Angeles County Inmate Deaths

Jails can be very dangerous places even in the best of circumstances. According to the Prison Policy Initiative, “Violence in prison is commonplace, tied to trauma prior to incarceration as well as mental health stressors inside. The rate of homicide in state prison is 2.5 times greater than in the U.S. population when adjusted for age, sex, and race/ethnicity.” Inmates face a variety of other hazards.

  • Elderly inmates are at risk of falling in a jail.
  • Inmates face health risks due to overcrowding and poor sanitation.
  • Inmates are subject to abuse and discrimination within the jail system.
  • Inmates may also be injured due to various forms of neglect.

Jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes harm brought on by an accident or a fall within the jail. When a jail has actual or constructive notice of a dangerous condition, they must act. There are a number of ways that an inmate may sustain a spinal injury within a jail system.

  • Many inmates are injured in falls every year.
  • Many inmates are the victims of medical malpractice.
  • Many inmates are the victims of abuse or neglect by jail officials.

A large portion of jail deaths are preventable. This is particularly true when any death is listed as an “accident.” Sadly, though, jails are rarely ever transparent about how any death takes place. This is why it is so important that evidence is properly preserved. The family of any person that died in a county jail may have legal recourse through a civil claim.
