GROVER BEACH, CALIFORNIA (January 24, 2025) – A man has tragically died in a Grover Beach police shooting near Grand Avenue and 13th Street.
Grover Beach police officials are saying that the incident took place around 6:23 p.m. on May 25. Officers received a call about a man who allegedly displayed a firearm to another person.
When officers arrived at the scene, they were initially unable to locate the suspect. A few minutes later, officers responded to a man who is allegedly causing a disturbance by throwing rocks at passing cars.
A Grover Beach police officer contacted the man. He allegedly became uncooperative and approached the officer before being shot.
A replica firearm was later recovered at the scene. Paramedics were called in order to help the man. But life-saving measures were not successful, and he later was pronounced dead.
Legal Considerations For Grover Beach Police Shootings
Thousands of people are killed or seriously injured in police encounters every year. Many of these incidents involve people who are unarmed and holding replica weapons. According to the Public Policy Institute of California, “In about 80 percent of encounters resulting in death or a gunshot wound, the civilian was armed with a weapon, underscoring the risky environments officers face. However, when we also consider civilians who sustained other serious injuries, 56 percent were unarmed.” There are several steps that police officers should take in order to prevent deadly encounters.
- Police officers should wait for back-up in high-risk situations.
- Police officers should attempt to de-escalate encounters.
- Police officers should use tasers and other less lethal measures before resorting to their firearms.
- Police officers should work closely with mental health units in certain encounters.
The ability to use lethal force is one of the most consequential powers that police officers hold. It must be used with great discretion. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. If a police officer uses excessive force and kills a suspect, this could form the basis of a constitutional claim. It is important that certain steps are taken after any fatal police shooting.
- Body camera footage from all officers involved should be reviewed.
- Medical records related to the shooting should be collected.
- The history of misconduct of any officers involved should be understood.
- An experienced civil rights attorney should be contacted.
Police shootings are often highly preventable. They tend to involve situations where officers are either unwilling or unable to de-escalate encounters. In many situations, officers will perceive ordinary objects as potentially dangerous weapons. The family of any person killed in a police shooting may be able to seek some measure of accountability through a civil rights claim. A civil rights attorney could examine the unique facts of your case and let you know what your legal options are.
