Legal Considerations For San Diego County Police Shootings
A disproportionate number of police shootings involve suspects who were suffering from an untreated mental illness. According to the Treatment Advocacy Center, “The risk of being killed while being approached or stopped by law enforcement in the community is 16 times higher for individuals with untreated serious mental illness than for other civilians.” Police officers should take a number of actions if they encounter a suspect they believe may be suffering from a mental illness.
- Request backup
- Calm the situation
- Avoid physical contact
- Determine if the suspect is taking medication
- Acknowledge the suspect’s feelings
- Not make any threats
Police officers should always use the least amount of force necessary for any given encounter. They can be held liable for any instance of excessive force. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law, or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. When an officer fails to follow a safety rule of their employer, this could serve as evidence of negligence.
Depending on the facts of any case, a police department could potentially be liable for the actions of their officers even if those officers were off-duty. If there is a justifiable claim that an off-duty police officer engaged in misconduct while asserting his or her official authority, this could form the basis of a civil claim. For example, an officer may have displayed their badge or brandished a firearm and said that they are a cop. It is important that certain steps are taken after any police shooting.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A police report should be created.
- Eyewitnesses should be interviewed.
Many police shootings can be prevented. They tend to involve officers that were either unwilling or unable to de-escalate encounters. In many situations, police officers fail to follow guidelines for people dealing with a mental illness. It is crucial that victims of police misconduct understand that they do have rights. The family of any person who died in a police shooting may have legal recourse through a civil claim.
