Legal and Custodial Significance

Even pre-trial detainees retain constitutional rights under the Fourteenth Amendment, including protection from deliberate indifference to serious medical needs. Authorities must ensure:

  • Comprehensive medical intake evaluations
  • Prompt recognition and response to distress signals
  • Ongoing monitoring of known health issues

Failure to fulfill these responsibilities may warrant a federal civil rights action under 42 U.S.C. § 1983 for neglect or inadequate care.
