California Set To Close FCI Dublin Women’s Prison After At Least Eight Employees Have been Charged With Sexually Abusing Inmates

DUBLIN, CALIFORNIA (April 16, 2024) – California women’s prison FCI Dublin is set to close after numerous correctional officers at the prison have been charged with or convicted of sexually abusing inmates.

The Federal Bureau of Prisons announced its plan to close the prison on Monday. FCI Dublin, which has infamously been nicknamed ‘the rape club,’ has a very troubled past.

The prison started to receive a lot of negative attention after the Associated Press exposed a culture of rampant sexual abuse involving jail staff. There have been a total of eight correctional officers at FCI Dublin so far who have been charged with sexually abusing inmates.

Sexual abuse was not the only problem that plagued FCI Dublin. There are also reports that inmates were being exposed to hazardous mold, asbestos, and inadequate healthcare.

The women who are currently housed at the prison are set to be transferred elsewhere.

Liability For Sexual Abuse At Alameda County Jails

Sexual abuse in prisons is far more common than many people may realize. According to the Bureau of Justice Statistics, “Correctional administrators reported 27,826 allegations of sexual victimization in 2018, a 14% increase from the 24,514 reported in 2015. Of the 1,673 substantiated incidents of sexual victimization in 2018, about 58% were perpetrated by other inmates and 42% by staff.” Sexual misconduct can come in many different forms in a prison setting.

  • Jail guards may inappropriately touch inmates.
  • Jail guards may fail to intervene to help inmates at risk of sexual assault by other inmates.
  • Jail guards may have coerced inmates into sexual relationships.

According to California Penal Code 289.6 (a), it is illegal for any correctional officer to have any type of sexual relationship with an inmate. This includes relationships that are ‘consensual.’ Depending on the facts of any case, a jail could be liable if an inmate is sexually abused by a jail guard. Jails have a legal obligation to protect inmates from foreseeable sources of harm. This includes sexual abuse involving prison guards. It is important that certain steps are taken after any instance of inmate sexual abuse.

  • Surveillance footage should be sought.
  • A police report should be created.
  • An experienced civil rights attorney should be contacted.

Sexual abuse inside any prison is rarely an isolated incident. In many situations, an assailant may have multiple victims. Abuse is also more likely to take place in jails that fail to take steps to safeguard the very inmates that they are supposed to be protecting. It is important that victims of sexual abuse understand that they do have rights. Any person who is sexually abused in a California jail may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
