Liability For West Hollywood Police Shootings

Police shootings remain alarmingly common across the United States. According to the Public Policy Institute of California, “More than four in ten people treated for non-fatal gunshot wounds from a police encounter were diagnosed with a mental health condition, an alcohol- or substance-related disorder, or both.” Police officers should take a number of actions in order to avoid harming suspects.

  • Police offices should work to de-escalate encounters.
  • Police officers should follow a use-of-force continuum.
  • Police officers should wait for backup in high-risk situations.

Police officers must always use the least amount of force necessary for any given situation. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. Victims of police brutality tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Laceration
  • Puncture wounds

It is important that all evidence related to a police shooting is properly preserved. In particular, the actions of police officers leading up to a shooting should be understood. The family of any person who died in a police shooting may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
