Liability For Los Angeles County Inmate Deaths

Los Angeles has one of the highest rates of inmate deaths across California. Many factors have contributed to this trend. According to the Vera Institute of Justice, “The death toll in LA jails—the nation’s largest jail system—is driven by severe overcrowding, inadequate care inside jails, and a failure to offer robust alternatives to incarceration.” Inmates have complained about numerous forms of mistreatment.

  • Inmates have been placed in solitary confinement for extended periods.
  • Inmates have been subjected to physical abuse by guards and other inmates.
  • Inmates have been denied medical care for their health conditions.

All jails have a legal obligation to take care of the inmates that they house. This includes care for all of their medical conditions. The level of care that any inmate may need will depend on their unique health profile. Some inmates may need care for chronic health conditions while others only need occasional checkups. Inmates may die due to any number of health conditions including:

  • Heart disease
  • Cancer
  • Septic shock
  • Respiratory illnesses

Not every failure to give an inmate proper care will rise to the level of a constitutional violation. Rather, when a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. Evaluating inmate death cases can be very complicated. This is why it is so important to seek the guidance of legal counsel early on. A civil rights attorney can examine the unique facts of your case and let you know what your legal options are.
