Inmate David Dodd Killed In Suspected Homicide At Kern Valley State Prison In Delano

pexels-rdne-stock-project-6069522DELANO, CALIFORNIA (April 10, 2024) – An inmate at the Kern Valley State Prison in Delano identified as David Dodd has tragically died in a suspected homicide.

Kern County officials are saying that the incident took place around 10:00 a.m. on Friday. Correctional officers said that David Dodd was attacked by another inmate with some type of weapon.

Correctional officers were able to eventually stop the fight and help the victim. David Dodd was treated for major injuries and puncture wounds.

But those efforts were not successful, and he was later pronounced dead. A full investigation remains ongoing at this time.

Liability For Kern County Inmate Deaths

Homicides remain one of the leading causes of inmate death in the United States. According to the Bureau of Justice Statistics, “Ten in 100,000 state prisoners died from homicide in 2018, the highest homicide rate in state prisons since 2001.” Jails should take a number of steps to prevent inmate homicides.

  • Jail staff should be trained in conflict resolution and de-escalation techniques.
  • Jails should typically segregate violent inmates away from non-violent inmates.
  • Jails should maintain adequate staffing levels at all times.

Depending on the facts of any case, a jail could be liable for the death of an inmate. Jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes attacks at the hands of other inmates. If a jail has specific knowledge of particular threats and fails to protect an inmate, this could form the basis of a constitutional claim. It is important that evidence is properly preserved after any inmate’s death.

  • Eyewitnesses should be interviewed.
  • Medical records should be collected.
  • Jail records should be sought.
  • An experienced civil rights attorney should be contacted.

Jail deaths are often highly preventable. This is particularly the case when deaths are due to homicide or suicide. Sadly, though, jails will do everything in their power to deny liability if an inmate dies in their care. This is why it is so important to have any in custody death independently analyzed by a civil rights attorney. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
