Liability For Marin County Jail Inmate Deaths

Thousands of inmates die in custody every year. According to the Behind Bars Data Project, “In 2020, at least 6,182 people died in U.S. prisons. This is a 46% increase in the lives lost behind bars from 2019, despite a 10% decrease in the overall prison population.” There are a number of common causes of inmate death.

  • Homicide
  • Respiratory illness
  • Septic shock
  • Heart attack

All jails have a legal obligation to provide every inmate with reasonably adequate medical care. Failing to give inmates medical care is a form of cruel and unusual punishment and is therefore prohibited. The medical care that inmates must receive starts when they enter the jail. They should get a thorough health screening. Inmates should also get periodic wellness checks throughout their stay. There are a number of ways that a jail may have failed to properly care for an inmate.

  • Jail officials may have failed to give an inmate medication.
  • Jail officials may have failed to get an inmate to the hospital in a timely manner.
  • Jail officials may have failed to help an inmate going through an overdose.

Jails are often quick to claim that any inmate’s death was “natural.” But this is often not the case. Many supposedly natural deaths involve some amount of medical neglect. For example, an inmate may have deteriorated after one of their health conditions was not properly treated. The family of any inmate who died in custody may be able to seek some measure of justice through a civil claim.
