Liability For Imperial County Inmate Attacks

Violence within the prison system is all too common. According to the Prison Policy Initiative, “The number of homicides in state prisons reached a record high of 120 deaths in 2018, a reminder that while prisons are secure, they are largely unsafe. Violence in prison is commonplace, tied to trauma prior to incarceration as well as mental health stressors inside. The rate of homicide in state prison is 2.5 times greater than in the U.S. population when adjusted for age, sex, and race/ethnicity.” Jails should take a number of measures in order to reduce violent attacks on inmates.

  • Jails should typically segregate violent inmates away from non-violent offenders.
  • Jails should do their best to prevent inmates from gaining access to weapons.
  • Jail officials should always treat the inmates in their care with dignity and respect.

Jails have a legal obligation to protect the inmates in their care. This includes protecting inmates from the violent actions of other people within the prison system. When a jail has specific knowledge that an inmate is in danger from a particular threat and fails to act, this could form the basis of a constitutional claim. Victims of inmate attacks tend to suffer very serious injuries including:

  • Broken bones
  • Stab injuries
  • Lacerations
  • Head injuries
  • Organ damage

There is typically no single factor that will cause an inmate homicide. Rather, violence tends to  be the result of numerous failures within a prison system. This could include under-staffing. The family of any person that died within a county jail may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
