Liability For Los Angeles County Inmate Deaths

California has one of the highest instances of inmate death. There are many different factors that could contribute to an inmate death. According to the Bureau of Justice Statistics, “Between 2001 and 2004, State prison authorities nationwide reported a total of 12,129 State prisoner deaths to the Deaths in Custody Reporting Program (DCRP).* Nearly 9 in 10 of these deaths (89%) were attributed to medical conditions. Fewer than 1 in 10 were the result of suicide (6%) and homicide (2%), while alcohol/drug intoxication and accidental injury accounted for another 1% each.” There are many steps that jails should take to prevent inmate deaths.

  • Inmates should get a thorough health screening when they are first admitted.
  • Inmate should get mental health treatment after they are admitted.
  • Inmates should get regular welfare checks during their stays.
  • Jails should be equipped with Narcan in the event of an overdose.

Jails have a legal obligation to provide inmates with reasonably adequate healthcare for their medical conditions. This includes mental healthcare. Inmates are exposed to a wide variety of abuses and trauma during their incarceration. Many people who enter jail have been the victims of physical, sexual and psychological abuse. It is therefore not surprising that suicide is one of the leading causes of inmate deaths. Jails should take a number of actions to prevent inmates from harming themselves.

  • Jails should develop and implement strict suicide prevention policies.
  • Jails should have specialized units for inmates at greater risk of self-harm.
  • Jails should always do their best to treat inmates with dignity and compassion.

It can be hard to know where to begin after any inmate death. To make matters worse, jails will often fail to be transparent about how any inmate in their custody dies. This is why it is so important that evidence is properly preserved after any in-custody death. The family of any person that dies in custody may be able to seek some measure of justice through a civil claim. A civil rights attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
