RANCHO CORDOVA, CALIFORNIA (October 8, 2024) – A former employee at the Royal Gardens Elder Care facility identified as Joel Gonzales was arrested after allegations he sexually abused patients.

The defendant was accused of committing multiple crimes over a three-day period. Prosecutors claim that Joel Gonzales assaulted two patients at Royal Gardens Elder Care.

He then allegedly broke into a house and threatened to kill a six-year-old girl having her first sleepover. Joel Gonzales pleaded guilty to all of the charges against him in August and is facing 16 years in prison.

Legal Considerations For Sexual Assaults At Nursing Homes

Sexual abuse at nursing homes remains all too common. According to Nursing Research and Practice, “Nursing homes are not free from sexual abuse, and both staff and residents have been identified as perpetrators. Residents in nursing homes are particularly vulnerable and at risk of abuse because they are more or less dependent on their caregivers owing to chronic illnesses, especially those with cognitive and behavioral problems.” Nursing homes should take a number of measures in order to prevent sexual abuse.

  • All employees should undergo thorough background checks.
  • All employees should undergo staff training and education.
  • Nursing homes should have clear reporting procedures.
  • Nursing homes should understand the factors that contribute to sexual abuse and predation.

Nursing homes have a legal obligation to protect patients from reasonably foreseeable sources of harm. This includes sexual abuse at the hands of employees. When a nursing home owner knew (or should have known) that an employee posed a risk to patients, they must act. Failing to act could form the basis of a civil claim. Many legal claims involving sexual abuse at nursing homes are based on the theory that the perpetrator was negligently hired or retained. There are several elements that must be demonstrated in any negligent hiring claim.

  • The worker was unfit for their position or posed a unique danger to residents.
  • The worker’s employer knew (or should have known) about the danger.
  • The unfit nature of the worker caused harm to the victim.
  • The company’s negligent hiring or retention was a substantial factor in causing the harm.

Sexual abuse is nearly always preventable in a nursing home setting. It tends to occur at nursing homes with systemic safety failures. This may include instances where nursing homes are understaffed. It may also include instances where nursing homes fail to perform adequate background checks. Any person sexually abused at a nursing home may be able to seek some measure of justice through a civil claim. A nursing home sexual abuse attorney can examine all of the unique facts of your case and let you know what your legal options are.
