Liability For Los Angeles County Bus Accidents

Buses are typically very safe for their passengers. But they can be quite dangerous for pedestrians and those in smaller vehicles. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.” Bus companies should take a number of measures in order to prevent accidents.

  • Bus drivers should use their turn signals to let other drivers know about their intentions.
  • Bus drivers should be well rested before heading out onto the road.
  • Bus drivers should check their blind spots before making turns.

Bus drivers are considered common carriers, and their drivers are held to a high standard in terms of safety. Many collisions involve bus drivers who make dangerous turns on the roadway. According to California Vehicle Code 21801, the driver of any vehicle making a left turn must yield the right of way to vehicles traveling from the opposite direction that are close enough so as to pose a hazard. It is important that certain steps are taken after any bus accident.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Photos of the accident site should be taken.
  • A thorough investigation should be conducted.

When a bus driver acts negligently, the company or municipal entity that they work for could be held at fault. Generally speaking, employers are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Any person who is injured in a bus accident may be able to seek some level of justice through a civil claim.
