32-year-old Gabriel Arellanes has been arrested after being accused of an on-duty sexual assault. Arellanes was an officer with the Claremont Police Department who had only resigned in January 2025. He was arrested a week after the San Bernardino County District Attorney’s Office charged him with a felony count of forcible oral copulation tied to an arrest of a 38-year-old Highland woman.
Details of the Allegations
According to authorities, Arellanes found the woman and her children’s father “engaged in romantic activities” in the backseat of a car on Mt. Baldy Road in Claremont. Noticing a glass pipe in the vehicle, he had the woman arrested on misdemeanor possession of drug paraphernalia, though the man was left behind. Arellanes has been accused of sexually assaulting the woman several times while taking her to the police station. After a female officer searched the woman, she was cited and released. However, Arellanes has been accused of offering the woman a ride to a transit center, only to use the opportunity to sexually assault her again.
Arellanes was arrested on March 14, 2025 by deputies of the San Bernardino County Sheriff’s Specialized Investigations division. He posted bail a day after his arrest and was released. He is scheduled to appear in Rancho Cucamonga Superior Court on April 30, 2025 for this felony charge.
Legal Implications and Civil Rights Considerations
Allegations of on-duty sexual assault raise serious civil rights violations under 42 U.S. Code § 1983, which allows victims of law enforcement misconduct to seek legal action against government officials who violate their constitutional rights. In California, sexual assault by a law enforcement officer could also be prosecuted under Penal Code § 243.4, which criminalizes sexual battery. Convictions under this statute carry severe penalties, including prison time and mandatory registration as a sex offender.
Furthermore, a 2022 study published by the Cato Institute found that police sexual misconduct is among the most underreported forms of law enforcement abuse, with many victims fearing retaliation or disbelief when coming forward.
