pexels-pixabay-236380LOS ANGELES, CALIFORNIA (November 27, 2024) – A 59-year-old inmate has tragically died in a suspected attack while staying at a Los Angeles County jail.

Los Angeles County officials are saying that the incident took place on Tuesday. Correctional officers noticed that one inmate was seriously injured and unresponsive.

Paramedics were called to the scene in order to help the victim. He was taken to a neurointensive care unit at the Los Angeles General Medical Center.

Despite life-saving measures, he was later pronounced dead at the jail. A full investigation into the death remains ongoing at this time.

Legal Considerations for Los Angeles County Inmate Deaths

Jails can be very violent places, even in the best of circumstances. A large number of inmates are killed in attacks involving other inmates. According to the Bureau of Labor Statistics, “Homicide was the cause of 2% of state and nearly 3% of federal prison deaths. There were 120 homicides of state prisoners during 2018, including homicides committed by other prisoners, incidental to the use of force by staff, and resulting from injuries sustained prior to incarceration.” Jails should take a number of actions in order to prevent homicides.

  • Jails should perform a comprehensive risk assessment for all inmates.
  • Jails should be staffed with well-trained correctional officers.
  • Jails should install and maintain security systems.
  • Jails should provide all inmates with mental health support.

Jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes protecting inmates from attacks at the hands of other inmates. If a jail shows deliberate indifference to a known risk of harm, this could form the basis of a constitutional claim. There are a number of mistakes that a jail may make that contributed to a homicide.

  • Jails may have placed rival gang members in the same cell.
  • Jails may have failed to protect an inmate whom they knew was the regular target of attacks.
  • Jails may have failed to properly monitor inmates.
  • Jail staff may have failed to intervene in an attack.

Inmate deaths are often highly preventable. This is particularly true when an inmate death is due to a drug overdose or homicide. Sadly, though, jails will often deny any responsibility if any inmate dies in their care. The family of any inmate who died in a county jail may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
