MILPITAS, CALIFORNIA (December 20, 2024) – A 30-year-old inmate has tragically died in custody while staying at the Elmwood Correctional Facility in Milpitas.

Santa Clara County officials are saying that the incident took place around 9:09 p.m. on December 17. Correctional officers noticed that the inmate was unresponsive in his jail cell.

Jail staff began life-saving measures, which were taken over by paramedics. The inmate was taken to the hospital, but their condition continued to decline.

They were pronounced dead at the hospital.

Legal Considerations for Santa Clara County Inmate Deaths

Thousands of inmates die in custody every year in the United States. According to the Bureau of Justice Statistics, “A total of 4,234 persons died in state and federal prisons in 2019, a 6.6% decrease from the 4,515 deaths in 2018 reported to the Bureau of Justice Statistics’ (BJS) Mortality in Correctional Institutions (MCI, formerly the Deaths in Custody Reporting Program) data collection.” There are a number of common causes of inmate death.

  • Homicide
  • Suicide
  • Drug overdoses
  • Drug withdrawal

Jails have a legal obligation to take reasonable measures in order to protect inmates from reasonably foreseeable sources of harm. This requires that inmates get medical attention for all of their needs. If a jail is deliberately indifferent to the medical needs of an inmate, this could form the basis of a constitutional claim. It is important that the circumstances surrounding any inmate death are properly investigated.

  • The number of inmate deaths at the facility should be understood.
  • Surveillance footage of the incident should be sought.
  • Autopsy records should be reviewed.

Jails are often quick to label inmate deaths as natural. But the fact of the matter is that this designation is often highly misleading. It is important to examine the medical treatment (or lack thereof) an inmate received prior to their death. In many situations, jails are not properly staffed, and there are simply not enough people to check on inmates to make sure that they are alright.
