SANTA CLARA, CALIFORNIA (December 28, 2024) – A 49-year-old inmate has tragically died in custody at the Elmwood Correctional Facility in Santa Clara County.

Santa Clara County officials are saying that the incident took place on Friday. Correctional officers noticed that the inmate was unresponsive in his jail cell.

Jail staff began lifesaving measures, which were taken over by paramedics. Despite those efforts, he was pronounced dead two days after being found unresponsive.

A full investigation remains ongoing at this time. A preliminary investigation revealed that suicide may have been the cause of death.

Legal Considerations for Santa Clara County Inmate Deaths

Suicide remains one of the main causes of inmate death in the United States. According to the Bureau of Justice Statistics, “From 2001 to 2019, the number of suicides increased 85% in state prisons, 61% in federal prisons, and 13% in local jails. During 2010-19, suffocation, including hanging and self-strangulation, accounted for nearly 90% of suicide deaths in local jails.” It is critical that jails take certain measures in order to prevent these deaths.

  • All inmates should have a thorough mental health screening when they are first admitted.
  • All inmates should be treated with dignity and respect at all times.
  • Jails should closely monitor inmates at heightened risk of suicide.

Jails have a legal obligation to protect inmates from all reasonably anticipated sources of harm. This includes self-harm. Going to jail is the lowest point that many people will go through. Jails must recognize this and take steps to protect the mental health of inmates. There are a number of ways that a jail may have failed to properly care for an inmate.

  • A jail may have failed to give an inmate the medication that they need.
  • A jail may have failed to adequately monitor an inmate.
  • A jail may have failed to place an inmate in a specialized cell.

Inmate deaths are often highly preventable. This is particularly true when a death is due to a drug overdose or suicide. Sadly, though, jails will often do everything in their power to deny responsibility when an inmate dies in their care. This is why it is so important that evidence is properly preserved after any in-custody death.
