Paramedics were called to the scene in order to help the inmate. But he was not able to be revived and ultimately died in custody.
A full investigation into the death remains ongoing at this time.
Legal Considerations For Riverside County Inmate Deaths
Riverside County jails have a long history of failing to properly care for inmates. According to the Desert Sun, “Four families have filed separate federal lawsuits against the Riverside County Sheriff’s Department claiming their relatives died in the county’s jails last year due to failures in training and emergency medical treatment.” There are a number of factors that could lead to mistreatment and civil rights violations in a jail setting.
- Inadequate training and supervision
- Overcrowding
- Lack of access to medical and mental health care
- Excessive use of force
- Discrimination and targeted abuse
Jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. Many inmate deaths are the result of excessive force. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is important that certain steps are taken after any inmate death.
- The autopsy reports for the death should be examined.
- A thorough investigation should be conducted.
- An experienced civil rights attorney should be contacted.
Inmate deaths are often highly preventable. Jails are often quick to claim that any inmate death was “natural.” But many inmate deaths listed as natural involved neglect in one way or another. For example, many inmates have died after having a seizure and falling in their jail cells. Had these inmates been given anti-seizure medication, those incidents may have been prevented. The family of any inmate who died in custody may be able to seek some measure of justice through a civil claim.
