Sacramento County officials are saying that the incident took place on November 7. The female inmate was evaluated by the jail’s medical staff and taken to the hospital.

Sadly, the inmate was later pronounced dead on Tuesday morning. A full investigation remains ongoing at this time.

Legal Considerations For Sacramento County Inmate Deaths

Thousands of inmates die in custody every year in the United States. Many of these deaths are entirely preventable. According to The Guardian, “Institutional failures and policy violations by the US Bureau of Prisons (BoP) have contributed to hundreds of preventable deaths of incarcerated people in recent years, according to a federal watchdog report released on Thursday.” Jails should take a number of measures in order to prevent inmate deaths.

  • All jails should make sure that inmates undergo a health screening before they are admitted.
  • All jails should be stocked with Narcan, which can be used to prevent inmate overdoses.
  • All jails should closely monitor inmates at risk of adverse health outcomes.

Jails have a legal obligation to provide inmates with medical care for all of their conditions. Failing to give inmates access to medical care is a violation of their constitutional rights. If a jail is deliberately indifferent to the serious medical needs of an inmate in their care, this could form the basis of a constitutional claim. It is important that certain steps are taken after any death.

  • The history of deaths at the jail should be understood.
  • Medical records related to the death should be collected.
  • An experienced civil rights attorney should be contacted.

It can be hard to know where to begin after any inmate deaths. To make matters worse, jails are almost never totally transparent about what took place. Jails will often claim that an inmate death is “natural,” but many of the deaths listed as natural actually involve some amount of medical neglect. The family of any inmate who died in custody may be able to seek some measure of justice through a civil claim.
