Legal Considerations For Sacramento County Inmate Deaths

Inmate deaths are incredibly common in the United States and across California. According to National Public Radio, “At least 6,182 people died in state and federal prisons in 2020, a 46% jump from the previous year, according to data recently released by researchers from the UCLA Law Behind Bars Data Project.” There are a number of common causes of inmate death.

  • Homicide
  • Suicide
  • Drug overdoses
  • Heart attacks

Jails have a legal obligation to tend to the medical needs of the inmates in their care. This must begin when an inmate is first brought into the jail. They must undergo a health screening and be given all of the support that they need. If a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a civil claim. It is important that evidence is properly preserved after any inmate death.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • An independent autopsy may need to be performed.

There are numerous failures that may have led to any particular inmate deaths. One of the major problems at many jails in California is that guards do not always perform required wellness checks. There was one instance where a man died in LA County jail custody while correctional officers were watching YouTube videos on their computers. The family of any inmate who died in custody may be able to seek some measure of justice through a civil claim.
