Legal Considerations For Riverside County Inmate Deaths
Drug overdoses remain a major cause of inmate deaths. But what many people don’t realize is that drug withdrawal can also be deadly. According to American Addiction Centers, “Drug withdrawal is a physiological response to the sudden quitting or slowing of use of a substance to which the body has grown dependent on. The various types of drug withdrawal syndromes may involve different combinations of physical, mental, and emotional symptoms—some of which can prove dangerous if left unmanaged.” There are a number of signs that an inmate may be going through withdrawal.
- Flu-like symptoms
- Gastrointestinal distress
- Headaches
- Fatigue
- Tremors
Jails have a legal obligation to take reasonable steps to protect inmates from harm. This includes taking steps to protect inmates who are at risk of being harmed by drug withdrawal. Generally speaking, inmates at risk of withdrawal will undergo medical detoxification. This is done under the supervision of medical professionals. It is important that evidence is properly preserved after any inmate death.
- Medical records should be collected.
- Surveillance footage should be sought.
- Eyewitnesses should be interviewed.
- An independent autopsy may need to be performed.
It’s always a good idea to seek the legal guidance of an experienced civil rights attorney after any death in a county jail. These institutions will fight hard to release information. They are also likely to say that any inmate death was “natural.” An attorney can examine the unique facts of your case and let you know if some amount of medical neglect contributed to your loved one’s death.
