Liability For Los Angeles County Jail Deaths
Homicides remain a leading cause of inmate deaths in the United States. According to the Bureau of Justice Statistics, “State prisoners in 2018 were slightly more likely to die of cancer, liver disease, and suicide and more than twice as likely to die from homicide than the adjusted population of adult U.S. residents.” Jails should take a number of measures in order to prevent inmate homicides.
- Jails should work to prevent weapons from entering the jail system.
- Jails should typically keep violent offenders away from non-violent inmates.
- Jails should promote conflict resolution between inmates.
All jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes protection from attacks at the hands of other inmates. When a jail is aware that an inmate is particularly at risk from a specific harm, they must take action. Failing to take action in such a circumstance could form the basis of a constitutional claim. Victims of jail attacks tend to suffer very serious injuries.
- Head trauma
- Blunt force injuries
- Lacerations
- Stab injuries
- Death
Homicides are often completely preventable in a jail setting. They tend to occur in jails with systemic injuries such as overcrowding. When jails are overcrowded, this can lead to conflict and competition among inmates who compete for limited resources. The family of any person who died in a county jail may have legal recourse through a civil claim.
