DELANO, CALIFORNIA (September 21, 2024) – An inmate identified as Jacob Kober has tragically died while in custody at Kern Valley State Prison in Delano.

Kern County officials are saying that the incident took place around 7:20 p.m. on September 19. Correctional officers found Jacob Kober unresponsive in his cell with serious injuries.

He had injuries consistent with an inmate-manufactured weapon. Jacob Kober was transported to the prison’s triage area, but he was later pronounced dead.

The death is currently being investigated as a homicide.

Liability For Kern County Inmate Death

Violence remains commonplace in prisons and jails across California.  According to Statista, “In 2019, 143 inmates of state and federal prisons in the United States were killed by homicide. This is a significant increase from 2008 levels, when 40 inmates were killed in state or federal prisons in the United States.” There are a number of factors that could contribute to violence in a jail setting.

  • Violence is more likely in jails that are overcrowded. Overcrowding may force inmates to compete over limited resources.
  • Violence is more likely when jails are not adequately staffed.
  • Violence is more likely when violent offenders are placed in cells with non-violent inmates.

All jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes violence at the hands of other inmates. When a jail is deliberately indifferent to an inmate being at risk of violence, this could form the basis of a constitutional claim. There should be a thorough investigation after any in-custody death.

  • Medical records related to the death should be collected.
  • Eyewitnesses should be interviewed.
  • Surveillance footage should be sought.
  • An experienced civil rights attorney should be contacted.

Inmate deaths due to homicide are highly preventable. They tend to be the result of systemic failures within any jail system. Sadly, though, jails will often do everything in their power to deny responsibility when an inmate dies in their care. The family of any inmate that died in custody may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
