Legal Considerations for Orange County Inmate Deaths
Drug overdoses are a major cause of inmate death in the United States. According to the Journal of Correctional Healthcare, “Drugs and alcohol are the third leading cause of death in U.S. jails. We analyzed 2000 to 2013 national jail mortality data by coding text data. We identified 1,442 deaths associated with drugs and alcohol.” There are a number of steps that jails should take in order to prevent inmate drug-related deaths.
- All inmates should undergo a thorough intake screening and assessment.
- Jails should provide medical and mental health services. This should include medically supervised detoxification for inmates undergoing withdrawal.
- Jails should take a number of measures to prevent contraband from entering inside in the first place.
Depending on the facts of any particular case, a jail or private healthcare provider could be liable for the death of an inmate in their care. When the state assumes control over a person’s autonomy, certain constitutional standards will apply. This is particularly important when an inmate has a history of substance abuse. Failing to properly treat inmates who are addicted to drugs or alcohol can be deadly. It is important that evidence is properly preserved after any inmate death.
- Medical records related to the death should be collected.
- An independent autopsy may need to be performed.
- The history of deaths at the jail should be understood.
- Surveillance footage should be sought.
Jail deaths are often highly preventable. This is particularly true when an inmate death is due to drug overdose or drug withdrawal. Part of the problem is that jails are only designed to house people temporarily. Staff are often unused to dealing with inmates with serious medical or mental health needs. When a jail fails to properly care for an inmate who dies in their care, they can be held to account through a civil claim.
