Liability For Los Angeles County Inmate Deaths
Violence is all too common in prisons across the United States. According to the Bureau of Justice Statistics, “Homicide was the cause of 2% of state and nearly 3% of federal prison deaths. There were 120 homicides of state prisoners during 2018, including homicides committed by other prisoners, incidental to the use of force by staff, and resulting from injuries sustained prior to incarceration (figure 3).” There are many factors that can influence the likelihood of a jail homicide.
- Homicides are more likely to occur at jails that are understaffed. Jails can be a difficult place for both inmates and correctional officers. These institutions tend to have high rates of turnover.
- Homicides are more likely to occur when inmates are not adequately monitored.
- Homicides are more likely when jails fail to segregate inmates with rival gang affiliations.
Jails have a legal obligation to provide inmates with a reasonably safe environment. This includes protecting inmates from attacks at the hands of other inmates. When a jail has specific knowledge of particular threats they must act. If a jail has such knowledge and fails to act, this could form the basis of a constitutional claim. Inmates may sustain very serious injuries after an attack.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Death
Homicides are often highly preventable in jails. They tend not to happen in a vacuum. Unfortunately, it is common for jail officials to deny any responsibility if any inmate in their care dies. This is why it is so important that all evidence is properly preserved. Evidence will paint a picture of what happened regardless of what any person might claim. The family of any person that died in-custody may have legal recourse through a constitutional claim.
