Legal Considerations For Riverside County Inmate Deaths
The Cois M. Byrd Detention Center has been the subject of numerous lawsuits over the years following a string of inmate deaths. According to Patch, “Families of three inmates who died while in custody at Riverside County correctional facilities filed federal civil rights lawsuits Wednesday against the county and Sheriff Chad Bianco over what the plaintiffs allege were failures to ensure the defendants received appropriate treatment.” There are a number of common causes of inmate deaths in a jail setting.
- Drug overdoses
- Drug withdrawal
- Suicides
- Homicides
Every jail has a legal obligation to protect inmates from harm. This includes providing them with adequate care for all of their health conditions. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. There are a number of different ways that a jail may have failed to properly care for an inmate.
- Jail officials may not have provided aid to an inmate going through a drug overdose.
- Jail officials may have failed to medically clear an inmate.
- Jail officials may have failed to take an inmate to the hospital in a timely manner.
Jail deaths are often highly preventable. They tend to be the result of systemic failures within any jail system. This may include instances where jails are understaffed. If a jail does not have enough medical personnel, this can affect the quality of care that all inmates receive. The family of any inmate that died in custody may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
