DELANO, CALIFORNIA (August 17, 2024) – A man identified as Johnny Victor has tragically died in a suspected attack at the Kern Valley State Prison in Delano.

Kern County officials are saying that the incident took place on Friday. Johnny Victor was attacked by two other inmates with manufactured weapons.

Prison staff were eventually able to stop the attack. Paramedics were called to the scene in order to help the victim.

He was taken to the jail facility infirmary, where he was later pronounced dead. A full investigation remains ongoing at this time.

Liability For Kern County Inmate Deaths

Homicide remains one of the leading causes of inmate death in the United States. According to the Bureau of Justice Statistics, “state prisoners in 2018 were slightly more likely to die of cancer, liver disease, and suicide and more than twice as likely to die from homicide than the adjusted population of adult U.S. residents.” Jails should take a number of different actions in order to prevent homicides.

  • Jails should have well-trained staff that know how to de-escalate encounters.
  • Jails should do their best to prevent overcrowding.
  • Jails should promote a culture of kindness and cooperation.

Jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes attacks at the hands of other inmates. When a jail has specific knowledge of a particular threat against an inmate and fails to take action, this could form the basis of a constitutional claim. It is important that certain steps be taken after any inmate’s death.

  • Jail records related to the victim and assailant should be sought.
  • Medical records should be preserved.
  • The circumstances leading up to the death should be understood.

The vast majority of jail homicides are completely preventable. They tend to involve situations where jails fail to properly supervise the actions of inmates in their care. Sadly, though, jails will often do everything in their power to deny responsibility if someone in their care dies. This is why it is so important that all inmate deaths are thoroughly investigated.
