gunRichmond, CA – On the evening of February 4, 2025, Richmond police officers fatally shot an unarmed man, 51-year-old Jose Mendez Rios, following a 30-minute standoff by the Union Pacific Railroad near the 300 block of Carlson Boulevard.

Incident Overview

Officers located the suspect near the railway tracks and attempted to take him into custody and eventually led to a prolonged standoff. An object the suspect wielded that appeared to be a knife was later determined to be a knife sheath.

Investigation and Legal Implications

In accordance with California state law, the California Department of Justice has initiated an investigation into the incident, as it involves the fatal shooting of an unarmed civilian by law enforcement officers. Attorney General Rob Bonta announced the state’s involvement, emphasizing the commitment to a thorough and impartial review of the circumstances surrounding the shooting.

Under California Penal Code § 835a, law enforcement officers are authorized to use deadly force only when necessary to defend against an imminent threat of death or serious bodily injury to the officer or another person. The determination of whether the use of force was justified will depend on the findings of the ongoing investigation.

Civil Rights Considerations

The fatal shooting of an unarmed individual by police raises significant civil rights concerns. Families of those affected by such incidents may have legal recourse if evidence suggests that law enforcement officers used excessive or unjustified force.
