MONTEREY COUNTY, CALIFORNIA (February 16, 2025) – A man identified as Jose Zamudio has died in a Monterey County police shooting in an agricultural field off Highway 183.
Monterey County officials are saying the incident took place on January 29. Police got a call about a suspect who allegedly tried to hit a casino employee with a vehicle.
Authorities were eventually able to locate Jose Zamudio along Highway 183. Sometime shortly after that encounter, a deputy opened fire and hit the suspect.
Paramedics were called to the scene in order to help the man. Despite life-saving measures, Jose Zamudio was later pronounced dead.
The incident remains under investigation by the California Attorney General’s Office.
Legal Considerations for California Police Shootings
California has one of the highest instances of police shootings. Many of the shootings involve suspects who were unarmed. According to the Public Policy Institute of California, “In about 80 percent of encounters resulting in death or a gunshot wound, the civilian was armed with a weapon, underscoring the risky environments officers face. However, when we also consider civilians who sustained other serious injuries, 56 percent were unarmed.” Many of these incidents involve people in the midst of a mental health crisis. It is important that police officers take certain steps in order to avoid deadly police shootings.
- Police officers should typically wait for backup in high-risk situations.
- Police officers should attempt to de-escalate encounters.
- Police officers should determine if the suspect is taking any medications.
All police officers have a legal obligation to use the least amount of force necessary for any given encounter. Lethal force should always be an absolute measure of last resort. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is important that evidence is properly preserved after any police shooting.
- Body camera footage from all officers involved should be reviewed.
- The circumstances leading up to the shooting should be understood.
- The history of misconduct of the officers involved should be investigated.
- A thorough investigation should be conducted.
Police shootings are often highly preventable. They tend to involve officers that are either unwilling or unable to de-escalate encounters. When police departments investigate themselves, they will often come to the conclusion that their officers did nothing wrong. This is why it is so important that all fatal police shootings are thoroughly investigated by an outside agency. This can help reveal if police officers engaged in official misconduct.
