Legal Considerations

Under 42 U.S. Code § 1983, individuals who believe their civil rights have been violated by law enforcement officers may pursue legal action if the officers used excessive force during an encounter.

Additionally, California has established guidelines governing the use of deadly force by law enforcement officers. Assembly Bill 392, which took effect in 2020, updated the standards for when officers can use lethal force, limiting its use to situations where it is deemed “necessary” rather than merely “reasonable.”

Use of Force by Law Enforcement

According to data from the California Department of Justice, over 700 use-of-force incidents resulting in serious injury or death have been reported statewide in recent years. Nationally, statistics from the Mapping Police Violence Project indicate that approximately 1,200 people are killed by police officers each year, with the majority of cases involving individuals experiencing mental health crises.
