Legal Considerations for Shasta County Inmate Deaths
Thousands of inmates die in custody every year in the United States. According to the Vera Institute of Justice, “Medical neglect kills hundreds of incarcerated people every year despite the 1976 Supreme Court ruling that deliberate indifference to medical needs amounts to cruel and unusual punishment. The COVID-19 pandemic compounded the impact of this inadequate care, with nearly 3,000 incarcerated people dying due to the virus since March 2020.” Inmates across California have experienced numerous forms of medical neglect.
- Inmates have reported not getting the medication that they needed.
- Inmates have often not received the mental healthcare that they needed.
- Inmates have died after not getting adequate medical detoxification.
- Inmates have not gotten care for serious medical issues, such as seizures and overdoses.
All inmates have a constitutional right to receive reasonably adequate care for all of their medical conditions. The level of care that an inmate will need depends greatly on their health status. Many people entering jail have pre-existing health conditions that require them to need certain types of medications or treatment. But far too often these conditions are ignored. If a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. It is important that evidence is properly preserved after any inmate dies in custody.
- Body camera footage from all officers involved should be reviewed.
- Surveillance footage that may have captured the incident should be examined.
- An independent autopsy may need to be performed.
- A thorough investigation of the incident should be conducted.
Jails are often quick to claim that any inmate death in their care was natural. But the fact of the matter is that many deaths listed as natural actually involved some amount of medical neglect. This could include instances where an inmate is not given adequate care for a serious health condition. It is important that inmates and their families understand that they do have rights. The family of any person who died in jail custody may be able to seek some measure of accountability through a civil claim.
