Liability For Sacramento County Inmate Deaths

Understaffing remains a major contributing factor to inmate deaths across the United States. This is particularly true in Los Angeles County. According to the Vera Institute, “Shoddy and understaffed health care and mental health services are likely contributing to the death rate in custody. The county can meet its basic obligation to prevent more deaths by reducing the jail population and backfilling positions for care providers to help alleviate the staffing crisis.” Several other factors may contribute to inmate deaths.

  • Drug overdoses
  • Unsanitary living conditions
  • Untrained staff
  • Overcrowding

All jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes protecting inmates from overdoses and attacks at the hands of other inmates. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. It is crucial that evidence is properly preserved after any inmate’s death.

  • Work logs for the officers responsible for the inmate should be reviewed.
  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • An independent autopsy may need to be performed.

Jails are often quick to label inmate deaths as “natural.” However, many inmate deaths involve some amount of medical neglect. This could include instances where inmates are not taken to the hospital in a timely manner. The family of any inmate who died in custody may be able to seek some measure of justice through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
