Legal Considerations for Delhi Police Shootings
Thousands of people are harmed during police encounters every year in California. Many of these encounters involved people with serious mental health needs. According to the Public Policy Institute of California, “More than four in ten people treated for non-fatal gunshot wounds from a police encounter were diagnosed with a mental health condition, an alcohol- or substance-related disorder, or both.” Police departments should take a number of actions in order to reduce the likelihood of fatal police encounters.
- Police officers should be equipped with less lethal measures such as tasers.
- Police officers should always work to de-escalate encounters to the best of their ability.
- Police departments should have units that specialize in encounters with suspects in the midst of a mental health crisis.
Police officers have a legal obligation to always use the least amount of force necessary for any given encounter. Lethal force should only be used as an absolute measure of last resort. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. Certain steps should be taken after any police shooting.
- Body camera footage from all officers involved should be collected.
- Surveillance footage from the area should be reviewed.
- Medical records related to the incident should be preserved.
- An experienced civil rights attorney should be contacted.
The actions of police officers leading up to any encounter will help determine whether or not their use of force was reasonable. Even if a police officer’s actions seemed reasonable in the moment, they may have been excessive given what led up to the shooting. It is important for victims of excessive force to understand that they do have rights. They are able to seek some measure of accountability through a civil rights claim.
