Liability For Los Angeles County Police Shootings
Thousands of people are killed during police shootings every year in the United States. Many of these shootings involve suspects who are mentally ill. According to the International Bipolar Foundation, “Nationwide, at least 25% of people who are shot and killed by police officers suffer from acute mental illness at the time of their death. People with untreated mental illness are 16 times more likely to be fatally shot during an encounter with police than people with their mental illnesses under control.” Officers should take several measures if they encounter a suspect they believe may be suffering from a mental illness.
- The police should utilize de-escalation techniques.
- The police may need to call in specialized units.
- The police should assess for immediate danger.
- The police should use non-lethal force first.
All police officers in California should operate under a use-of-force continuum. In other words, officers should only escalate their force when it is absolutely necessary. Officers can be liable for their use of excessive force. . Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is crucial that evidence is properly preserved after any police shooting.
- The actions of officers leading up to the shooting should be understood.
- Body camera footage from all officers involved should be collected.
- Eyewitnesses should be interviewed.
There are specific protocols that police officers should take if they encounter a suspect who is mentally ill. When a police officer fails to follow a safety rule promulgated by their employer, this could serve as evidence of negligence. The family of any person killed in a police shooting may have legal recourse through a civil claim.
