SAN BRUNO, CALIFORNIA (February 4, 2025) – A 13-year-old boy identified as Kayo Amed was injured in a San Bruno garbage truck accident while riding a scooter near Niles Avenue and Chesnut Avenue.
San Mateo County officials are saying that the accident took place around 3:30 PM on Thursday. A 37-year-old Recology garbage truck driver from Watsonville hit Kayo Amed as he was riding a scooter.
According to witnesses, the garbage truck was backing up at the time of the collision. Paramedics were called to the scene of the accident in order to help the victim. He was pulled from underneath the truck and taken to the hospital with serious injuries.
Family members are saying that Kayo Amed will likely need to be hospitalized for several weeks due to the severe nature of his injuries.
Legal Considerations For San Bruno Garbage Truck Accidents
Pedestrians lack the protection provided by enclosed vehicles and are uniquely vulnerable in car accidents. According to the National Safety Council, “The National Center for Health Statistics (NCHS) estimates 9,188 pedestrians died in traffic or non-traffic incidents in 2022. Non-traffic incidents occur on non-traffic ways such as driveways, parking lots, or other private property.” There are a number of reasons that garbage trucks can be particularly dangerous.
- Garbage trucks have large blind spots that can obscure the presence of pedestrians and smaller vehicles.
- Garbage trucks can weigh tens of thousands of pounds, making them incredibly dangerous even at lower speeds.
- Garbage trucks operate almost entirely in residential areas, which means they routinely cross paths with pedestrians.
Garbage truck drivers have a legal obligation to exercise a great deal of care in order to avoid hitting a pedestrian. Pursuant to California Vehicle Code 21950, drivers must yield the right-of-way to any pedestrian crossing within a lawfully marked crosswalk. Drivers are also required to check their blind spots before backing up. There is a rebuttable presumption of negligence on the part of any driver who reverses into a vehicle or pedestrian.
The company that a garbage truck driver worked for could also be held at fault for a collision. Generally speaking, companies are vicariously liable for the wrongful actions of their employees – insofar as those workers were operating within the course and scope of their job duties. This may include instances where a truck driver was delivering materials or transporting goods. Victims of garbage truck accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Amputations
- Spinal cord injuries
- Organ damage
Even after a person’s physical injuries have healed, many survivors of car accidents suffer long-term psychological injuries. This may include post-traumatic stress disorder (PTSD). This may manifest in recurring thoughts or nightmares about the accident. Any person injured in a garbage truck accident may be able to seek some measure of justice through a personal injury claim. Damages in a civil claim can help cover medical bills, lost wages, and pain and suffering related to the incident.
