Liability For Inmate Deaths At The San Diego Central Jail

Thousands of inmates die every year in jails and prisons across the United States. According to the Bureau of Justice Statistics, “In 2019, there were 1,200 deaths in local jails, a more than 5% increase from 2018 (1,138 deaths). The local jail mortality rate in 2019 was 167 deaths per 100,000 inmates, up 11% from 2000 (151 per 100,000).” Inmates face a variety of health challenges during their incarceration.

  • The physical and psychological stressors from incarceration are known to exasperate pre-existing health conditions.
  • A large portion of inmates enter the jail system as victims of physical abuse and mental health disorders.
  • Inmates also suffer from heart disease in higher numbers.

Jails have a legal obligation to provide all inmates with access to reasonably adequate healthcare. The level of care that any inmate may need will depend largely on their unique health profile. Inmates are supposed to be medically cleared before they are put in prison cells. But this does not always happen. There are a number of ways that jail officials may have inadvertently contributed to any inmate’s death.

  • Jail officials may have delayed getting an inmate medical care.
  • Jail officials may not have performed periodic wellness checks on an inmate.
  • Jail officials may not have followed the medical directions of healthcare professionals.

There are typically clear signs that an inmate is in medical distress. As an inmate’s health deteriorates, these signs may become more and more obvious. In far too many situations, jails will delay getting an inmate care until it is too late. The family of any person that died in a county jail may be able to seek some measure of justice through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
