Silverado Senior Living Management Facing Felony Charges After Deadly Covid-19 Outbreak

LOS ANGELES, CALIFORNIA (October 27, 2024) – A Los Angeles assisted living facility identified as Silverado Senior Living Management is facing felony charges for a Covid-19 outbreak.

Thirteen residents and a nurse reportedly died in the outbreak. An estimated 45 employees at the facility contracted Covid.

Prosecutors said that it was one of the worst outbreaks of Covid-19 at an assisted living facility in California. The facility allegedly admitted a new resident on March 19, 2020.

The facility allegedly failed to test the patient for Covid-19 or quarantine the patient prior to their admission. Three managers at the facility have been charged with 13 counts of felony elder endangerment.

A full investigation into the incidents remains ongoing at this time.

Legal Consideration For Nursing Home Facility Deaths

Nursing homes suffered some of the highest rates of death from Covid. According to The Covid-19 Tracking Project, “About 8% of people who live in US long-term-care facilities have died of COVID-19—nearly 1 in 12. For nursing homes alone, the figure is nearly 1 in 10. The most complete figures we can assemble are both an estimate and a severe undercount of the true impact on long-term-care residents.” Nursing homes should take a number of measures in order to prevent Covid-19 deaths.

  • Nursing homes should offer residents vaccines.
  • Nursing homes should have infection control protocols.
  • Nursing homes should have clear visitation guidelines.
  • Nursing homes should have proper ventilation.

Nursing homes have a legal obligation to properly care for all of their residents. They must protect them from reasonably foreseeable sources of harm. This includes protecting them from Covid and other infectious diseases. When a nursing home fails to follow protocol for dealing with outbreaks, this could form the basis of a negligence claim. It is important that certain steps are taken after any death at a nursing home.

  • Medical records related to the death should be collected.
  • A thorough investigation should be conducted.
  • An experienced personal injury attorney should be contacted.

Deaths at nursing homes are often highly preventable. It is common for them to be the result of systemic failures within a care facility, as opposed to the wrongful actions of a single person. Sadly, though, nursing homes will often do everything in their power to deny responsibility when a person in their care dies. This is why it is so important that residents of nursing home misconduct and their families seek legal advice as early as possible.
