LOS ANGELES, CALIFORNIA (July 21, 2024) – A man identified as Luis Florez has tragically died in a Los Angeles police shooting by the intersection of Venice Boulevard and Vermont Street.

Los Angeles County officials are saying that the incident took place on July 10. Los Angeles Sheriff’s Deputies got a call about a potential carjacking.

The officers responded to the scene and encountered Luis Florez. At some point during the encounter, deputies fired multiple shots through a car window and struck the suspect.

Paramedics were called to the scene in order to help the suspect. Despite life-saving measures, Luis Florez  died due to his injuries.

Authorities are saying that the man was unarmed when he was shot and killed. The incident is currently being investigated by the California attorney general.

Liability For Los Angeles Police Shootings

California has one of the highest instances of police shootings in the United States. Many of the victims of these shootings were unarmed. According to the Public Policy Institute of California, “In about 80 percent of encounters resulting in death or a gunshot wound, the civilian was armed with a weapon, underscoring the risky environments officers face. However, when we also consider civilians who sustained other serious injuries, 56 percent were unarmed.” Police departments should take a number of measures in order to prevent police shootings.

  • Police officers should be trained to de-escalate encounters.
  • Police officers should be trained to understand when a suspect may be in the midst of a mental health crisis.
  • Police officers should be equipped with less-lethal options.

A police department could be liable for a police shooting if an officer used excessive force. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is important that certain steps are taken after any police shooting.

  • Body camera footage from all officers involved should be sought.
  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • An experienced civil rights attorney should be contacted.

Police shootings are often complex events. Whether or not any police shooting was justified under California law will depend in part on the actions of the officers leading up to the shooting. For example, if a police officer fails to follow a safety rule promulgated by their employer, this could serve as evidence. The family of any person who died in a police shooting may be able to seek some measure of justice through a civil claim.
