A full investigation remains ongoing at this time.
Liability For Los Angeles County Inmate Deaths
Los Angeles County has one of the highest instances of inmate death in all of California. This is due in part to the poor treatment that inmates are given within LA facilities. According to the Vera Institute of Justice, “The death toll in LA jails—the nation’s largest jail system—is driven by severe overcrowding, pervasive neglect and mistreatment, inadequate care inside jails, and a failure to offer robust alternatives to incarceration.” Jails should take a number of measures in order to prevent inmate deaths.
- All inmates should have a thorough health screening when they are first admitted.
- All inmates should receive periodic wellness checks during their stay.
- All inmates should receive ongoing medical care throughout their stay.
Every jail in California has a legal obligation to provide inmates with adequate medical care throughout their stay. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. For example, a jail may have failed to take an inmate to the hospital when they were in medical distress. Several different factors could contribute to inmates receiving inadequate care.
- Many jails in LA have been understaffed.
- Correctional officers may be poorly trained.
- Jails may not be stocked with Narcan, which can be used to reverse an overdose.
Many deaths within a jail or prison are preventable. They tend to involve some amount of neglect or oversight. Jails are quick to label inmate deaths as “natural.” But this designation can often be highly misleading. It is important that evidence is properly preserved after any inmate’s death. At the end of the day, evidence will help reveal what contributed to any in-custody death.
